Terms & Conditions
1. Acceptance of Terms By engaging our services, placing an order, requesting a quote, or accessing our website, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use our services.
2. Services Provided KCS Kustom Fab and Hauling (“we,” “us,” or “our”) provides custom metal fabrication, welding, repair, and hauling/transportation services (collectively, the “Services”). All Services are performed in a professional manner consistent with industry standards.
3. Quotes and Pricing

Quotes are valid for 30 days from the date issued unless otherwise stated.

Prices do not include applicable taxes, permits, freight, or any additional work not expressly described in the written quote.

We reserve the right to adjust pricing if the scope of work changes or if material/labor costs increase significantly after the quote is issued.
4. Payment Terms

A deposit of [50% or specify amount] is required on most projects before work begins.

Final payment is due upon completion of the Services or delivery, unless credit terms have been pre-approved in writing.

Overdue invoices are subject to a late fee of [1.5% per month] and may result in work stoppage or lien rights where applicable.

We accept payment by cash, check, bank transfer, or credit card (credit card payments may incur a processing fee).
5. Customer Responsibilities You agree to:

Provide accurate specifications, drawings, and information required for the project.

Ensure safe and legal access to the job site for hauling and delivery.

Obtain all necessary permits and approvals unless we have expressly agreed to do so.

Pay for any additional work caused by inaccurate information or site conditions.
6. Change Orders Any changes to the original scope of work must be agreed in writing. Additional charges and schedule adjustments may apply.
7. Scheduling and Delays

Estimated completion dates are not guaranteed. Delays caused by weather, material shortages, customer changes, or events beyond our control are not our responsibility.

We are not liable for consequential or indirect damages caused by delays.
8. Delivery and Hauling
-
Risk of loss passes to you upon delivery or loading onto your carrier.

You are responsible for unloading unless otherwise agreed in writing.

Oversized or overweight loads may require special permits (cost borne by customer unless otherwise agreed).
9. Warranty
-
We warrant that our workmanship will be free from defects for a period of one (1) year from the date of completion, subject to normal use and proper maintenance.

This warranty does not cover damage caused by misuse, improper installation by others, normal wear and tear, corrosion (unless specific coating was applied), or modifications made without our approval.

Our sole obligation under this warranty is to repair or replace defective workmanship at our discretion.

THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
10. Limitation of Liability To the fullest extent permitted by law:

Our total liability shall not exceed the amount paid by you for the Services giving rise to the claim.

We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, even if advised of the possibility.
11. Indemnification You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your negligence, misuse of our products/services, or violation of these Terms.
12. Termination We may terminate or suspend Services immediately if you fail to make payment, breach these Terms, or if continuation would violate any law or regulation.
13. Governing Law These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Tarrant County, Texas.
14. Force Majeure We are not responsible for delays or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, war, strikes, supply shortages, or government regulations.
15. Intellectual Property Any designs, drawings, or intellectual property created by us remain our property unless a separate written agreement transfers ownership.
16. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement These Terms constitute the entire agreement between you and KCS Kustom Fab and Hauling and supersede all prior agreements or understandings.
18. Amendments We reserve the right to update these Terms at any time. The current version will be posted on our website.
